Welcome to Bawnz.com, a re-commerce marketplace operated by Sapong Enterprises, headquartered at Brookridge, Dr. Pablo U. Abella St., Labangon, Cebu City, Philippines (“we,” “our,” “us”). By accessing, browsing, or using Bawnz.com (the “Platform”), you agree to comply with and be bound by the following Terms and Conditions (“Terms”). Please read them carefully before using our services.

1. Acceptance of Terms

By registering for an account, accessing, or using Bawnz.com, you agree to these Terms and our Privacy Policy. If you do not agree, please discontinue use of the Platform.

2. Eligibility

You must be at least 18 years old or have the consent of a parent/guardian to use Bawnz.com. By using the Platform, you represent that you meet these eligibility requirements and have the legal capacity to enter into binding agreements.

3. Account Registration

  • Registration is free of charge.
  • You agree to provide accurate, current, and complete information during registration.
  • Phone verification may be required to complete registration.
  • Sellers may be required to submit valid identification documents for verification before posting or completing transactions.
  • You are responsible for maintaining the confidentiality of your account and password.
  • You agree not to create multiple or fake accounts, impersonate others, or provide false information.

4. Listing Types and Usage

Bawnz.com allows users to post listings under the following categories:

  • Sell (items for sale)
  • Rent (items for temporary use)
  • Barter (items/services offered in exchange for other items/services)
  • Giveaways (items offered for free)

You agree that:

  • Listings must comply with applicable laws and these Terms.
  • Prohibited items (such as illegal goods, counterfeit products, restricted medical devices, hazardous materials, etc.) are not allowed.
  • Bawnz.com reserves the right to remove, edit, or moderate any listing at its discretion.

5. Fees and Payment

  • Creating an account and posting standard listings is free.
  • We may offer premium subscription plans and boosting add-ons to increase listing visibility.
  • Sell and Rent listings with successful transactions are subject to a 5% platform fee plus a bank transaction fee ranging from Php15 to Php30.
  • Sellers may request withdrawal of their earnings every Tuesday, with a cut-off of transactions every Friday.
  • Fees for paid services will be clearly communicated before purchase.
  • Payments are non-refundable unless otherwise stated.

6. User Responsibilities

You agree:

  • To only list items you own or have the right to sell, rent, barter, or give away.
  • To ensure your listings are accurate, updated, and not misleading.
  • To comply with all applicable Philippine laws, regulations, and consumer protection standards.
  • To interact respectfully with other users and not engage in fraudulent, abusive, or harmful behavior.

7. Transactions and Safety

  • Bawnz.com is a platform only and is not a party to transactions between users.
  • We do not guarantee the quality, safety, legality, or accuracy of listings.
  • Users are solely responsible for verifying counterparties, inspecting items, and conducting safe transactions.
  • Meet-ups are encouraged to be in safe, public places.
  • Users may report items, sellers, or other users who are suspected of violating these Terms, applicable laws, or community standards. Reports will be reviewed, and appropriate action may be taken.

8. Prohibited Conduct

Users may not:

  • Post illegal, fraudulent, defamatory, obscene, or offensive content.
  • Infringe intellectual property rights.
  • Spam, scam, or solicit users outside the Platform.
  • Use bots, automated systems, or scrape data from Bawnz.com.
  • Engage in activities that disrupt or damage the Platform.

9. Intellectual Property

  • All trademarks, logos, content, and software on Bawnz.com are the property of Sapong Enterprises or its licensors.
  • Users retain ownership of their content but grant Bawnz.com a non-exclusive, royalty-free license to use, display, and promote listings within the Platform.

10. Suspension and Termination

We may suspend, restrict, or terminate accounts without prior notice if:

  • Users violate these Terms.
  • Fraudulent or illegal activity is detected.
  • Required by law or government authorities.

11. Limitation of Liability

  • Bawnz.com is provided on an “as is” and “as available” basis.
  • We do not guarantee uninterrupted access, error-free operation, or absolute security.
  • Sapong Enterprises is not liable for damages, losses, fraud, or disputes arising from user transactions.

12. Indemnity

You agree to indemnify and hold harmless Sapong Enterprises, its officers, employees, and affiliates from claims, damages, or expenses resulting from your use of Bawnz.com, your listings, or your violation of these Terms.

13. Changes to Terms

We reserve the right to update or modify these Terms at any time. Continued use of Bawnz.com after changes indicates acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes shall be subject to the jurisdiction of the proper courts in Cebu City, Philippines.
